{"id":10055,"date":"2018-01-07T20:50:04","date_gmt":"2018-01-07T20:50:04","guid":{"rendered":"https:\/\/centregestor.es\/?p=10055"},"modified":"2020-12-04T20:50:25","modified_gmt":"2020-12-04T20:50:25","slug":"pasos-a-seguir-para-recibir-una-herencia-2","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/pasos-a-seguir-para-recibir-una-herencia-2\/","title":{"rendered":"Pasos a seguir para recibir una herencia"},"content":{"rendered":"<p>El fallecimiento de un ser querido es un momento vital dif\u00edcil de afrontar, por ello los tr\u00e1mites administrativos que derivan de la obtenci\u00f3n de la herencia suelen ser un engorro para aquellas personas que no est\u00e9n habituadas a realizar este tipo de gestiones.<\/p>\n<p>A continuaci\u00f3n, haremos una breve descripci\u00f3n sobre los seis pasos a seguir para poder recibir una herencia.<\/p>\n<p><strong>Paso 1. Obtenci\u00f3n de documentos necesarios<\/strong><\/p>\n<p>El primer paso a tener en cuenta cuando se gestiona una herencia es la obtenci\u00f3n de todos los documentos que servir\u00e1n como base para los tr\u00e1mites futuros\u00a0y son\u00a0los siguientes:<\/p>\n<p><strong>El certificado de defunci\u00f3n de la persona fallecida<\/strong><\/p>\n<p>El certificado de defunci\u00f3n es el\u00a0<strong>documento que prueba que la persona ha fallecido realmente<\/strong>, y se puede solicitar de forma presencial, por correo ordinario o por Internet.<\/p>\n<p><strong>El certificado del Registro General de Actos de \u00daltima Voluntad<\/strong><\/p>\n<p>El certificado del Registro General de Actos de \u00daltima voluntad es un documento por el cual\u00a0se comprueba si la persona fallecida otorg\u00f3 testamento v\u00e1lido o no en cualquier momento de su vida.<\/p>\n<p>Este certificado ser\u00e1 fundamental\u00a0porque no se puede proceder a la partici\u00f3n de la herencia sin conocer si la voluntad de la persona que deja los bienes.<\/p>\n<p><strong>El certificado del Registro de Seguros con cobertura de fallecimiento<\/strong><\/p>\n<p>El \u00faltimo documento a obtener de forma previa es el certificado del Registro de Seguros con cobertura de fallecimiento. Se trata de un documento que da fe acerca de si la persona fallecida ten\u00eda un contrato de seguro de vida o no que deba de desplegar efectos por su muerte.<\/p>\n<p><strong>Paso 2. Obtenci\u00f3n de una copia autorizada del testamento<\/strong><\/p>\n<p>Una vez conocida la situaci\u00f3n testamentaria del fallecido a trav\u00e9s de los certificados descritos en el punto anterior, habr\u00e1 que\u00a0acudir a la notar\u00eda indicada en el de \u00faltimas voluntades y solicitar una copia autorizada o compulsada del testamento.<\/p>\n<p><strong>Paso 3. Testamento o declaraci\u00f3n de herederos<\/strong><\/p>\n<p>Debemos comprobar si la persona fallecida realiz\u00f3 o no testamento para actuar en consecuencia:<\/p>\n<ul>\n<li><strong>Si hay testamento v\u00e1lido<\/strong>, en el documento aparecer\u00e1n los datos de la notar\u00eda donde se realiz\u00f3, por lo que ser\u00e1 necesario acudir a esta o a cualquier otra de notar\u00eda confianza y solicitar el testamento de la persona fallecida.<\/li>\n<li><strong>Si no hay testamento v\u00e1lido<\/strong>, ser\u00e1 necesario realizar el tr\u00e1mite de la declaraci\u00f3n de herederos, de modo que\u00a0<strong>uno de los herederos y dos testigos conocedores de la familia <\/strong>deber\u00e1n de acudir a una notar\u00eda del \u00faltimo domicilio de la persona fallecida y firmar con su consentimiento.<\/li>\n<\/ul>\n<p><strong>Paso 4. Inventario de bienes<\/strong><\/p>\n<p>Haya habido o no testamento, se deber\u00e1 realizar el inventariado de los bienes. En este tr\u00e1mite se investigan todos los bienes propiedad de la persona fallecida y la manera en que pueden ser repartidos.<\/p>\n<p><strong>Paso 5. Partici\u00f3n de la herencia <\/strong><\/p>\n<p>Tambi\u00e9n conocido como cuaderno particional, recoge la identificaci\u00f3n de todos los interesados en la herencia, el inventario de bienes, as\u00ed como las posibles deudas del fallecido y las adjudicaciones que se hacen a cada heredero o legatario. En este documento se expresa la decisi\u00f3n sobre qu\u00e9 bienes \u00a0corresponden a cada uno de los herederos.<\/p>\n<p><strong>Paso 6.
