{"id":10125,"date":"2017-06-14T21:22:12","date_gmt":"2017-06-14T21:22:12","guid":{"rendered":"https:\/\/centregestor.es\/?p=10125"},"modified":"2020-12-04T21:22:35","modified_gmt":"2020-12-04T21:22:35","slug":"reclame-el-sobreprecio-pagado-por-la-compra-de-su-camion-entre-1997-y-2011-2","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/reclame-el-sobreprecio-pagado-por-la-compra-de-su-camion-entre-1997-y-2011-2\/","title":{"rendered":"Reclame el sobreprecio pagado por la compra de su cami\u00f3n entre 1997 y 2011"},"content":{"rendered":"<p>La Comisi\u00f3n Europea ha sancionado a diversos <strong>fabricantes de camiones<\/strong> que han infringido el Derecho Comunitario: <strong>pactando entre s\u00ed los precios \u201cbrutos\u201d de los camiones desde el 17-01-1997 al 18-01-2011<\/strong>; obstaculizando la introducci\u00f3n de nuevas tecnolog\u00edas en materia de emisiones y repercutiendo a los compradores los costes de dichas tecnolog\u00edas. Los veh\u00edculos afectados son los camiones r\u00edgidos o cabezas tractoras con un peso de m\u00e1s de 6 toneladas.<!--more--><\/p>\n<p>Tras la sanci\u00f3n de la Uni\u00f3n Europea se abre el per\u00edodo para la <strong>reclamaci\u00f3n individual de los compradores afectados<\/strong> (empresarios o aut\u00f3nomos) por los sobrecostes sufridos en la adquisici\u00f3n (Compraventa, Leasing o Renting).<\/p>\n<p>\u00a0<\/p>\n<p>Para facilitar esta reclamaci\u00f3n ponemos a disposici\u00f3n de todos los posibles afectados, tanto desde el punto de vista jur\u00eddico como pericial-t\u00e9cnico, un solvente equipo de profesionales para determinar el sobrecoste y los perjuicios sufridos por los compradores y tramitar la reclamaci\u00f3n de dicha cuant\u00eda ante los fabricantes.<\/p>\n<p>\u00a0<\/p>\n<p>Ante un fraude como el protagonizado por los fabricantes de veh\u00edculos industriales, estamos enfocados a efectuar las reclamaciones pertinentes, creando la confianza y tranquilidad necesarias en este tipo de acciones.<\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00bfQu\u00e9 fabricantes han sido multados?<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>DAF, Daimler, Iveco, MAN, Volvo-Renault.<\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>*Scania, por el momento no ha sido sancionada, ya que no ha reconocido su implicaci\u00f3n en el c\u00e1rtel. La Comisi\u00f3n Europea de la Competencia a\u00fan est\u00e1 instruyendo un procedimiento de investigaci\u00f3n frente a dicho fabricante. En caso de emitirse Decisi\u00f3n en la que se estimase su implicaci\u00f3n en el c\u00e1rtel, podr\u00e1n iniciarse las reclamaciones oportunas frente a la misma.<\/em><\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00bfQu\u00e9 camiones est\u00e1n afectados?<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>Todos aquellos camiones r\u00edgidos y cabezas tractoras de m\u00e1s de 6 toneladas adquiridas a los fabricantes se\u00f1alados, excluy\u00e9ndose las adquisiciones de segunda mano, entre el 17 de enero de 1997 y el 18 de enero de 2011. (Excepto en el caso de veh\u00edculos del fabricante MAN para los cuales el periodo afecto a la reclamaci\u00f3n se extiende desde el 17 de enero de 1997 hasta el 20 de septiembre de 2010).<\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00bfQui\u00e9n puede reclamar?<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>Cualquier persona f\u00edsica o jur\u00eddica que haya comprado un veh\u00edculo nuevo de tales caracter\u00edsticas, o bien suscrito un contrato de financiaci\u00f3n -leasing o renting- dentro del referenciado periodo, independientemente de que a posteriori dicho veh\u00edculo haya sido objeto de trasmisi\u00f3n a un tercero.<\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00bfQu\u00e9 se reclama?<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>Podr\u00e1 reclamar los da\u00f1os y perjuicios ocasionados por las pr\u00e1cticas anticompetitivas llevadas a cabo por los fabricantes que componen el c\u00e1rtel. La formaci\u00f3n de este cartel europeo de fabricantes de camiones supuso y un incremento medio del 10% en el precio de los veh\u00edculos.<\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00bfHasta cu\u00e1ndo puedes reclamar?<\/strong><\/p>\n<p>\u00a0<\/p>\n<p>Las reclamaciones han de realizarse antes del <strong>pr\u00f3ximo 19 de Julio de 2017. <\/strong>Para garantizar su reclamaci\u00f3n dentro de plazo, aceptamos encargos <strong>hasta el 17 de julio. <\/strong><\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00bfQu\u00e9 documentaci\u00f3n se necesita?<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ul>\n<li>Factura de adquisici\u00f3n en caso de compra.<\/li>\n<li>P\u00f3liza de la entidad financiera en caso de arrendamiento financiero (leasing\/renting).<\/li>\n<li>Permiso de circulaci\u00f3n del veh\u00edculo objeto de reclamaci\u00f3n.<\/li>\n<li>Autorizaci\u00f3n de transporte de la empresa reclamante.
