{"id":10178,"date":"2017-01-03T22:27:26","date_gmt":"2017-01-03T22:27:26","guid":{"rendered":"https:\/\/centregestor.es\/?p=10178"},"modified":"2020-12-04T22:27:42","modified_gmt":"2020-12-04T22:27:42","slug":"registre-de-la-jornada-laboral-dels-treballadors-2","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/registre-de-la-jornada-laboral-dels-treballadors-2\/","title":{"rendered":"Registre de la Jornada Laboral dels treballadors"},"content":{"rendered":"<p>Amb la publicaci\u00f3 del Reial Decret Llei 16\/2013, de 20 de desembre, \u201cde medidas para favorecer la contrataci\u00f3n estable y mejorar la empleabilidad de los trabajadores\u201d, es va establir l\u2019obligatorietat de portar un registre diari de l\u2019horari dels <strong>empleats amb contracte a temps parcial<\/strong>.<\/p>\n<p><!--more--><\/p>\n<p>Despr\u00e8s d\u2019aquest canvi normatiu\u00a0 que ha suposat una nova obligaci\u00f3 per les empreses, hem tingut coneixement que des de la Inspecci\u00f3 de Treball s\u2019ha iniciat una campanya, en tots els sectors d\u2019activitat, exigint, no nom\u00e9s el registre de la jornada dels treballadors a temps parcials, <strong>sino tamb\u00e9 dels treballadors a temps complet.<\/strong><\/p>\n<p>Aquest decret obliga doncs, a registrar la jornada de tots els treballadors dia a dia, totalitzar-la mensualment i entregar junt amb el rebut de salaris, el resum de totes les hores realitzades en cada mes.<\/p>\n<p>La Inspecci\u00f3 de Treball, a trav\u00e9s d\u2019aquestes actuacions, pret\u00e9n evitar el frau en la realitzaci\u00f3 d\u2019hores extraordin\u00e0ries i procurar la seva correcta vigil\u00e0ncia, retribuci\u00f3 i cotitzaci\u00f3.<\/p>\n<p>A efectes pr\u00e0ctics del compliment d\u2019aquesta nova obligaci\u00f3 aquestes son les condicions del registre que l\u2019Empresa te que realitzar:<\/p>\n<ol>\n<li>Registre: La norma no estableix una forma espec\u00edfica per al registre diari de la jornada, per tan s\u2019ent\u00e9n que ser\u00e0 v\u00e0lid qualsevol sistema o mitja que permeti registrar de forma objectiva la jornada dels seus treballadors, amb les seves respectives hores d\u2019entrada i sortida. En el cas de no disposar en el seu centre de treball d\u2019un sistema de fitxatge inform\u00e0tic o electr\u00f2nic, es considera tamb\u00e9 v\u00e0lid qualsevol altre m\u00e8tode objectiu per gestionar aquest control, com pot ser un document o plantilla on en qualsevol cas figuri la seg\u00fcent informaci\u00f3:<\/li>\n<\/ol>\n<ul>\n<li>Identitat de l\u2019empresa<\/li>\n<li>Identificaci\u00f3 del treballador<\/li>\n<li>Especificaci\u00f3 de la hora d\u2019entrada i sortida<\/li>\n<li>Detall de les hores laborables realitzades i desglossades per dia efectiu de treball<\/li>\n<li>Firma del representant legal de la empresa<\/li>\n<li>Signatura del treballador<\/li>\n<\/ul>\n<ol start=\"2\">\n<li>El Responsable de l\u2019Empresa tindr\u00e0 que conservar este registre durant un per\u00edode m\u00ednim de 4 anys.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>Totalitzaci\u00f3: L\u2019Empresa, te que entregar junt als rebuts de salari, un resum totalitzant les hores realitzades. La norma admet que la c\u00f2pia d\u2019aquest resum mensual, s\u2019entregui al treballador tant en un document independent com que s\u2019inclogui en el propi rebut de salaris.<\/li>\n<\/ol>\n<p>Pel que fa a l\u2019incompliment d\u2019aquesta exig\u00e8ncia, la Inspecci\u00f3 de Treball, a part del corresponent requeriment pel seu immediat compliment, pot sancionar a l\u2019empresa. Si l\u2019incompliment es deu a q\u00fcestions formals o documentals es contemplaria una multa d\u2019entre 60,00 \u20ac i 625,00 \u20ac. Si pel contrari es constata un incompliment de la jornada la multa pot ser d\u2019entre 626,00 \u20ac en el seu grau m\u00ednim i 6.250,00 \u20ac en el seu grau m\u00e0xim. Que existeixi sanci\u00f3 o no, i la seva quantia, ser\u00e0 a criteri de l\u2019inspector en base al numero de treballadors de la empresa i dels requeriments efectuats anteriorment.
