{"id":10872,"date":"2021-04-30T14:41:39","date_gmt":"2021-04-30T14:41:39","guid":{"rendered":"https:\/\/centregestor.es\/?p=10872"},"modified":"2021-04-30T14:41:39","modified_gmt":"2021-04-30T14:41:39","slug":"com-complir-amb-el-nou-reial-decret-digualtat-salarial-en-la-teva-empresa","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/com-complir-amb-el-nou-reial-decret-digualtat-salarial-en-la-teva-empresa\/","title":{"rendered":"Com complir amb el nou Reial decret d&#8217;Igualtat Salarial en la teva empresa"},"content":{"rendered":"<h2>Noves mesures per a promoure la Igualtat Salarial entre g\u00e8neres<\/h2>\n<div data-pm-slice=\"1 1 []\" data-en-clipboard=\"true\">A l&#8217;abril entra en vigor el<strong> Reial Decret 902\/2020<\/strong> sobre <strong>igualtat retributiva entre dones i homes<\/strong>.<\/p>\n<p>A Espanya la <strong>bretxa salarial de g\u00e8nere\u00a0supera el 20% en els c\u00e0rrecs de direcci\u00f3<\/strong>, segons dades extretes de 8.444 empreses en un informe elaborat per un programari especialitzat en els recursos humans, Factorial. Un altre dels aspectes que destaca l&#8217;estudi \u00e9s que\u00a0en els salaris menors (sous de 10.000 euros o menys) la pres\u00e8ncia femenina \u00e9s major que la masculina, i al mateix temps en salaris m\u00e9s elevats el nombre d&#8217;homes \u00e9s significativament m\u00e9s alt que el de dones.<\/p>\n<p>Aquesta llei implanta mesures per a fer efectiu el dret d&#8217;igualtat de tracte i no discriminaci\u00f3 entre homes i dones en mat\u00e8ria retributiva, i que comporta complir amb <strong>els instruments que ho formen<\/strong>:<\/div>\n<ul>\n<li data-pm-slice=\"1 1 []\" data-en-clipboard=\"true\">Registre salarial o registre retributiu.<\/li>\n<li data-pm-slice=\"1 1 []\" data-en-clipboard=\"true\">Auditoria retributiva.<\/li>\n<li data-pm-slice=\"1 1 []\" data-en-clipboard=\"true\">Sistema de valoraci\u00f3 de llocs de treball de classificaci\u00f3 professional.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2 data-pm-slice=\"1 1 []\" data-en-clipboard=\"true\">Registre retributiu<\/h2>\n<div data-pm-slice=\"1 1 []\" data-en-clipboard=\"true\">Totes les empreses hauran de disposar d&#8217;un <strong>registre salarial<\/strong> o <strong>registre retributiu<\/strong> de tota la seva plantilla, incloent al personal directiu i els alts c\u00e0rrecs, sent aquesta retribuci\u00f3 concorde a les exig\u00e8ncies recollides en l&#8217;RD 902\/2020.<\/p>\n<p>Aix\u00f2 implica que partir d&#8217;<strong>abril de 2021 totes les empreses independentment del nombre de treballadors hauran de comptar amb un registre retributiu<\/strong> adaptat a aquest Reial decret llei, tant les que compten amb menys de 50 treballadors, com les que compten amb m\u00e9s de 50 treballadors i tenen en marxa plans d&#8217;igualtat.<\/div>\n<div data-pm-slice=\"1 1 []\" data-en-clipboard=\"true\"><\/div>\n<h3 data-pm-slice=\"1 1 []\" data-en-clipboard=\"true\">Quins elements ha de contemplar el registre retributiu<\/h3>\n<ul>\n<li>De <strong>car\u00e0cter anua<\/strong>l, tenint en compte les dades de l&#8217;any natural anterior.<\/li>\n<li>Inclour\u00e0 les seg\u00fcents <strong>dades<\/strong>:\n<ul>\n<li>Valors mitjans dels salaris.<\/li>\n<li>Complements salariares\u00a0\u00a0(per hores extres, plus gu\u00e0rdies\u2026).<\/li>\n<li>Percepcions extrasalarials (dietes, km\u2026).<\/li>\n<\/ul>\n<\/li>\n<li>Cadascun de les dades a incloure en el registre estar\u00e0 desglossat per:\n<ul>\n<li>Categoria professional.<\/li>\n<li>Grup professional.<\/li>\n<li>Lloc de treball diferenciat per g\u00e8nere.<\/li>\n<\/ul>\n<\/li>\n<li>Establir\u00e0 el c\u00e0lcul de la mitjana aritm\u00e8tica i mitjana del percebut per cada concepte.<\/li>\n<li>Haur\u00e0 d&#8217;incloure una justificaci\u00f3 de les dades resultants del registre quan existeixin <strong>difer\u00e8ncies iguals o superiors al 25%<\/strong>.<\/li>\n<li>Tots <strong>els treballadors tindran acc\u00e9s al registre salarial<\/strong> a trav\u00e9s dels representants legals. Si no hi hagu\u00e9s representant legal la informaci\u00f3 que es facilitar\u00e0 es limitar\u00e0 a les difer\u00e8ncies percentuals que existissin en les retribucions entre home i dones.<\/li>\n<\/ul>\n<div><\/div>\n<div>El Ministeri de Treball i Economia Social ha posat en marxa una <strong>eina per a la confecci\u00f3 del registre retributiu<\/strong> en el seg\u00fcent enllaci https:\/\/www.mites.gob.es\/<\/p>\n<p>Les empreses que no tinguin el registre, alguna cosa recollit en l&#8217;Estatut dels Treballadors, poden arribar a ser sancionades per no complir amb una de les obligacions que marca la norma sobre igualtat de g\u00e8nere. La multa pot oscil\u00b7lar entre els 625 i els 6.250 euros. Aix\u00f2 aplica a empreses la plantilla de les quals excedeixi de 100 treballadors i, a partir del pr\u00f2xim 7 de mar\u00e7 de 2022, aquelles la plantilla de les quals sigui d&#8217;entre 50 i 100 treballadors. <strong>Totes les empreses que hagin elaborat el Pla d&#8217;Igualtat han d&#8217;adaptar-lo incloent una auditoria salarial.<\/strong><\/p>\n<ul>\n<li>Ser\u00e0 obligat\u00f2ria per a les empreses que elaborin un pla d&#8217;igualtat o l&#8217;hagin desenvolupat volunt\u00e0riament.<\/li>\n<li>Tindr\u00e0 la vig\u00e8ncia del pla d&#8217;igualtat, de <strong>4 anys com a m\u00e0xim<\/strong>, tret que es determini una altra inferior en aquest.<\/li>\n<li><strong>Avalua els llocs de treball<\/strong>, tenint en compte les tasques i funcions de cada lloc.<\/li>\n<li>Establir\u00e0 un <strong>pla de correcci\u00f3<\/strong> de les desigualtats retributives, amb sistema de seguiment i les millores que aplicar\u00e0 per a rectificar-ho.<\/li>\n<\/ul>\n<\/div>\n<div>L&#8217;auditoria retributiva ser\u00e0 obligat\u00f2ria en aquelles empreses que hagin d&#8217;elaborar un Pla d&#8217;Igualtat Salarial. Igualtat Retributiva ha de basar-se en la idea que el salari ha d&#8217;anar concorde al valor del treball, independentment de qui el realitzi.<\/h4>\n<div>\n<div class=\"traductor-textarea form-group\">\n<div class=\"textarea-desti col-xs-12 col-sm-6\">\n<div class=\"form-control second-textarea\">Segons l&#8217;Estatut dels Treballadors:\u00a0<em>un treball t\u00e9 igual valor que un altre quan la naturalesa de les funcions o tasques efectivament encomanades, les condicions educatives, professionals o de formaci\u00f3 exigides per al seu exercici, els factors estrictament relacionats amb el seu desenvolupament i les condicions laborals en qu\u00e8 aquestes activitats es duen a terme en realitat siguin equivalents.<\/em><\/p>\n<p>Per a realitzar una correcta valoraci\u00f3 dels llocs de treball hauran d&#8217;aplicar-se tres criteris:<\/p>\n<\/div>\n<ul>\n<li class=\"form-control second-textarea\"><strong>Adequaci\u00f3<\/strong>: els factors rellevants en la valoraci\u00f3 han de ser aquells relacionats amb l&#8217;activitat i que de manera efectiva concorrin en aquesta, incloent la formaci\u00f3 necess\u00e0ria.<\/li>\n<li class=\"form-control second-textarea\"><strong>Totalitat<\/strong>: han de tenir-se en compte totes les condicions que particularitzen el lloc de treball.<\/li>\n<li class=\"form-control second-textarea\"><strong>Objectivitat<\/strong>: han d&#8217;existir mecanismes clars que identifiquin els factors que s&#8217;han tingut en compte en la fixaci\u00f3 d&#8217;una determinada retribuci\u00f3 i que no depenguin de factors o valoracions socials que reflecteixin estereotips de g\u00e8nere<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div class=\"traductor-checkbox form-group\">\n<div class=\"row\"><\/div>\n<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<h2 data-pm-slice=\"1 1 []\" data-en-clipboard=\"true\"><strong>La\u00a0Llei de Protecci\u00f3 de Dades protegeix la privacitat dels salaris<\/strong><\/h2>\n<p>L&#8217;empresa ha de <strong>protegir la privacitat de les persones<\/strong>\u00a0 encara que el registre retributiu sigui obligatori, podent limitar el lliurament d&#8217;aquests registres de salaris, ja que es pot donar el cas que nom\u00e9s hi hagi una persona en un grup professional concret i en donar aquesta informaci\u00f3 la hi estigui identificant de manera indirecta.<\/p>\n<div><\/div>\n<div>\n<div class=\"traductor-textarea form-group\">\n<div class=\"textarea-desti col-xs-12 col-sm-6\">\n<div class=\"form-control second-textarea\">En aquests casos, es pot estructurar la informaci\u00f3 de manera que es\u00a0<strong>busquin mitjans<\/strong>\u00a0(mitjan\u00e7ant agrupacions, associacions amb grups m\u00e9s gen\u00e8rics o altres t\u00e8cniques)\u00a0perqu\u00e8 la informaci\u00f3 <strong>no permeti identificar a una persona individual<\/strong>.<\/div>\n<\/div>\n<\/div>\n<div class=\"traductor-checkbox form-group\">\n<div
