{"id":8023,"date":"2019-01-27T00:00:00","date_gmt":"2019-01-27T00:00:00","guid":{"rendered":"https:\/\/centregestor.es\/les-mesures-aprovades-en-materia-dhabitatge-i-lloguer-queden-derogades-per-falta-de-convalidacio\/"},"modified":"2020-11-17T22:55:36","modified_gmt":"2020-11-17T22:55:36","slug":"les-mesures-aprovades-en-materia-dhabitatge-i-lloguer-queden-derogades-per-falta-de-convalidacio","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/les-mesures-aprovades-en-materia-dhabitatge-i-lloguer-queden-derogades-per-falta-de-convalidacio\/","title":{"rendered":"Les mesures aprovades en mat\u00e8ria d&#8217;habitatge i lloguer queden derogades per falta de convalidaci\u00f3"},"content":{"rendered":"<p>Els volem informar que la convalidaci\u00f3 del Reial decret-llei 21\/2018, de 14 de desembre (BOE de 18 de desembre de 2018 i en vigor el 19 de desembre), de mesures urgents en mat\u00e8ria d&#8217;habitatge i lloguer, ha estat debatuda en el ple del Congr\u00e9s dels Diputats del 22 de gener de 2019 i no ha comptat amb el suport de la Cambra,\u00a0<strong>per la qual cosa queda derogat, i es torna a aplicar la normativa vigent abans del 19 de desembre de 2018<\/strong>.<\/p>\n<p>Recordem que aquesta norma va introduir importants novetats en mat\u00e8ria d&#8217;habitatge i lloguer, entre d&#8217;altres:<\/p>\n<ul>\n<li class=\"first last\">S&#8217;ampliava el termini de pr\u00f2rroga obligat\u00f2ria dels contractes d&#8217;arrendament d&#8217;habitatge de 3 a 5 anys (o 7 anys si l&#8217;arrendador era persona jur\u00eddica) i s&#8217;allargava el termini de pr\u00f2rroga t\u00e0cita d&#8217;1 a 3 anys. A m\u00e9s, en el moment de la signatura del contracte, l&#8217;arrendador no podia exigir al nou inquil\u00ed un aval, al marge de la fian\u00e7a, que exced\u00eds en dos mesos la renda mensual de lloguer tret que es tract\u00e9s de contractes de llarga durada, i s&#8217;establia que les despeses de gesti\u00f3 immobili\u00e0ria i formalitzaci\u00f3 del contracte serien a c\u00e0rrec de l&#8217;arrendador, quan aquest fos persona jur\u00eddica (empresa o societat).<\/li>\n<\/ul>\n<ul>\n<li class=\"first last\">Tamb\u00e9 es modificava la Llei 49\/1960, de 21 de juliol, sobre propietat horitzontal, per a habilitar la possibilitat que, per majoria qualificada de tres cinquenes parts dels propietaris, en les comunitats de ve\u00efns es poguessin adoptar acords que limitessin o condicionessin l&#8217;exercici de l&#8217;activitat del lloguer tur\u00edstic d&#8217;habitatge, per a, d&#8217;aquesta forma, afavorir la conviv\u00e8ncia en els edificis d&#8217;habitatges.<\/li>\n<\/ul>\n<ul>\n<li class=\"first last\">Tamb\u00e9 s&#8217;introdu\u00efen canvis en la Llei d&#8217;Enjudiciament Civil perqu\u00e8 es paralitzessin els desnonaments fins que es trob\u00e9s una alternativa d&#8217;habitatge en els casos que afectessin persones o fam\u00edlies vulnerables.<\/li>\n<\/ul>\n<ul>\n<li class=\"first last\">S&#8217;establia l&#8217;exempci\u00f3 de l&#8217;impost sobre transmissions patrimonials i actes jur\u00eddics documentats (ITP i AJD) en la signatura de contractes d&#8217;arrendament d&#8217;habitatge per a \u00fas estable i permanent, de manera que es redu\u00efen les c\u00e0rregues fiscals que comporta el mercat del lloguer d&#8217;habitatge habitual. A m\u00e9s, es modificava la regulaci\u00f3 de l&#8217;impost sobre b\u00e9ns immobles (IBI) incorporant mesures que afavorien el mercat de lloguer d&#8217;habitatge.<\/li>\n<\/ul>\n<p>Doncs b\u00e9 com hem indicat anteriorment aquestes mesures ja no s\u00f3n aplicables, ja que el Reial decret-llei que les va aprovar no ha estat convalidat i per tant ha quedat derogat.<\/p>\n<p><strong>Qu\u00e8 succeir\u00e0 a partir d&#8217;ara? Qu\u00e8 passa amb els contractes de lloguer i operacions realitzades des del 19 de desembre de 2018?<\/strong><\/p>\n<p>L&#8217;article 86 de la Constituci\u00f3 assenyala que:<\/p>\n<p>1. En cas d&#8217;extraordin\u00e0ria i necessitat urgent, el Govern podr\u00e0 dictar disposicions legislatives provisionals que prendran la forma de Decrets llei i que no podran afectar l&#8217;ordenament de les institucions b\u00e0siques de l&#8217;Estat, als drets, deures i llibertats dels ciutadans regulats en el T\u00edtol I, al r\u00e8gim de les Comunitats Aut\u00f2nomes ni al Dret electoral general.<\/p>\n<p>2. Els Decrets llei hauran de ser\u00a0<strong>immediatament sotmesos a debat i votaci\u00f3 de totalitat al Congr\u00e9s dels Diputats<\/strong>, convocat a aquest efecte si no estigu\u00e9s reunit, en el termini dels trenta dies seg\u00fcents a la seva promulgaci\u00f3. El Congr\u00e9s s&#8217;haur\u00e0 de pronunciar expressament dins d&#8217;aquest termini\u00a0<strong>sobre la seva convalidaci\u00f3 o derogaci\u00f3<\/strong>, per a aix\u00f2 el Reglament establir\u00e0 un procediment especial i sumari.<\/p>\n<p>3. Durant el termini establert en l&#8217;apartat anterior, les Corts podran tramitar-los com a projectes de llei pel procediment d&#8217;urg\u00e8ncia.\u00bb<\/p>\n<p>En conseq\u00fc\u00e8ncia, en votar en contra de la convalidaci\u00f3 el Congr\u00e9s dels Diputats, s&#8217;ha d&#8217;entendre que el\u00a0<strong>Reial decret-llei 21\/2018 es trobar\u00e0 derogat quan es publiqui al BOE<\/strong>.<\/p>\n<p>Per la seva part l&#8217;article 151.6 del Reglament del Congr\u00e9s, estableix que l&#8217;acord de convalidaci\u00f3 o derogaci\u00f3 d&#8217;un Reial decret llei es publicar\u00e0 en el \u00abButllet\u00ed Oficial de l&#8217;Estat (BOE)\u00bb.<\/p>\n<p>Per tant,\u00a0<strong>haur\u00e0 estat en vigor des del 19 de desembre de 2018 fins a la publicaci\u00f3 al BOE de l&#8217;acord de derogaci\u00f3<\/strong>.<\/p>\n<p><strong>Els contractes signats durant aquest per\u00edode conserven el seu vigor, i estaran regits pels canvis que havia introdu\u00eft
