{"id":8048,"date":"2019-04-18T00:00:00","date_gmt":"2019-04-18T00:00:00","guid":{"rendered":"https:\/\/centregestor.es\/quin-es-el-termini-per-sol%c2%b7licitar-la-devolucio-dun-rebut-domiciliat-al-banc\/"},"modified":"2020-11-17T22:55:50","modified_gmt":"2020-11-17T22:55:50","slug":"quin-es-el-termini-per-sol%c2%b7licitar-la-devolucio-dun-rebut-domiciliat-al-banc","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/quin-es-el-termini-per-sol%c2%b7licitar-la-devolucio-dun-rebut-domiciliat-al-banc\/","title":{"rendered":"Quin \u00e9s el termini per sol\u00b7licitar la devoluci\u00f3 d&#8217;un rebut domiciliat al banc?"},"content":{"rendered":"<p>No sol passar habitualment, per\u00f2 en determinades ocasions se&#8217;ns carreguen imports de serveis en el nostre compte bancari que no es corresponen amb el que paguem mes a mes o ens passen factures de serveis que ja no utilitzem.<\/p>\n<p>En casos com aquests, ha de saber que pot demanar a la seva entitat banc\u00e0ria la devoluci\u00f3 d&#8217;aquest rebut.<\/p>\n<p>Tota persona t\u00e9 el dret de retornar qualsevol rebut, estigui domiciliat o no, excepte els de pagaments de pr\u00e9stecs o comissions, tret que l&#8217;entitat banc\u00e0ria hagi com\u00e8s un error.<\/p>\n<p>El <a href=\"https:\/\/www.boe.es\/eli\/es\/rdl\/2018\/11\/23\/19\">Reial decret llei 19\/2018<\/a>, de serveis de pagament i altres mesures urgents en mat\u00e8ria financera, estableix que t\u00e9 dret a devoluci\u00f3 en els casos en qu\u00e8 els rebuts estiguessin pr\u00e8viament autoritzats, si en donar l&#8217;autoritzaci\u00f3 no especifiquessis l&#8217;import exacte i si aquest import supera raonablement el que podies esperar tenint en compte les teves anteriors pautes de despesa, les condicions del teu contracte i altres circumst\u00e0ncies pertinents.<\/p>\n<p>En aquests casos, el termini m\u00e0xim de devoluci\u00f3 \u00e9s de <strong>vuit setmanes<\/strong>, comptades a partir de la data de deute dels fons en el seu compte. En <strong>deu dies h\u00e0bils<\/strong> des que rep la sol\u00b7licitud de devoluci\u00f3, l&#8217;entitat haur\u00e0 de retornar l&#8217;import del rebut o b\u00e9 justificar la seva denegaci\u00f3 de devoluci\u00f3, indicant en aquest cas els procediments de reclamaci\u00f3, judicials i extrajudicials, a la disposici\u00f3 de l&#8217;usuari, per al cas que l&#8217;ordenant no estigui conforme amb les raons ofertes.<\/p>\n<p>En el cas dels <strong>rebuts que no estiguessin autoritzats pr\u00e8viament<\/strong>, haur\u00e0 de comunicar a la seva entitat l&#8217;operaci\u00f3 no autoritzada sense tardan\u00e7a injustificada i sempre en un <strong>termini m\u00e0xim de tretze mesos<\/strong> des de la data del deute o abonament.<\/p>\n<p>Si no \u00e9s un consumidor, pot pactar amb la seva
