Qui pot promoure eleccions? Com haur\u00e0 d&#8217;actuar la seva empresa?<\/p>\n<p>Els treballadors tenen dret a tenir representants en l&#8217;empresa, \u00e9s la manera que sense ser accionistes ni propietaris, es poden fer escoltar, con\u00e8ixer com va l&#8217;empresa i fer-se tenir en compte en decisions que puguin afectar-los. Cal destacar que aquest dret no es pot suprimir, i qualsevol acci\u00f3 pot ser nul\u00b7la i fins i tot sancionable. Les eleccions sindicals s\u00f3n un dret del treballador reflectit en l&#8217;Estatut dels Treballadors (ET), aix\u00ed com en el Reial decret 1844\/1994, de 9 de setembre, pel qual s&#8217;aprova el Reglament d&#8217;eleccions a \u00f2rgans de representaci\u00f3 dels treballadors en l&#8217;empresa.<\/p>\n<p><strong>Promotors<\/strong><\/p>\n<p>Les eleccions poden ser promogudes pels sindicats o per acord de la majoria dels seus propis empleats. Per tant, encara que l&#8217;empresa no ho vulgui o encara que el promotor hagi estat un sindicat i no els seus treballadors, en la seva empresa se celebraran eleccions sindicals. En tot cas, revisi que es compleixen els seg\u00fcents requisits:<\/p>\n<ul>\n<li class=\"first last\">Han d&#8217;haver transcorregut almenys sis mesos des de l&#8217;inici de la seva activitat. En cas contrari, encara no pot haver-hi eleccions (encara que el conveni pot reduir aquest termini a tres mesos).<\/li>\n<\/ul>\n<ul>\n<li class=\"first last\">Els promotors han de comunicar a la seva empresa i a l&#8217;autoritat laboral el seu prop\u00f2sit de celebrar eleccions amb un preav\u00eds m\u00ednim d&#8217;un mes a l&#8217;inici del proc\u00e9s electoral.<\/li>\n<\/ul>\n<ul>\n<li class=\"first last\">La seva empresa ha de tenir un m\u00ednim de 6 treballadors (amb menys, la plantilla no t\u00e9 dret a nomenar representant). No obstant aix\u00f2, consulti el seu conveni, ja que alguns permeten que hi hagi representants en centres de menys de sis treballadors.<\/li>\n<\/ul>\n<p>En el c\u00f2mput d&#8217;aquest nombre m\u00ednim de 6 treballadors perqu\u00e8 sigui legalment possible promoure eleccions sindicals, s&#8217;han d&#8217;incloure tots els treballadors amb independ\u00e8ncia de si el seu treball \u00e9s indefinit o temporal.<\/p>\n<p><strong>Com es trien els representants dels treballadors?<\/strong><\/p>\n<p>Els representants es trine a trav\u00e9s d&#8217;unes eleccions en les quals voten els treballadors personalment, amb vot secret. Aquestes eleccions les poden promoure els anteriors representants dels treballadors, els sindicats m\u00e9s representatius o els propis treballadors per majoria.<\/p>\n<p>En aquestes eleccions poden votar tots els treballadors que siguin majors de 16 anys i que tinguin almenys un mes d&#8217;antiguitat en l&#8217;empresa. I poden ser triats els treballadors m\u00e9s grans\u00a0 de 18 anys amb una antiguitat d&#8217;almenys 6 mesos, tret que el conveni col\u00b7lectiu indiqui una antiguitat inferior. \u00c9s igual si els treballadors s\u00f3n espanyols o estrangers o si estan afiliats o no a un sindicat. I els treballadors seran triats per 4 anys.<\/p>\n<p><strong>Quants representants sindicals s&#8217;han de triar?<\/strong><\/p>\n<p>Existeixen b\u00e0sicament dos tipus de representants:\u00a0<strong>els delegats de personal i els comit\u00e8s d&#8217;empresa<\/strong>. Aquestes s\u00f3n les formes en la qual els treballadors s\u00f3n representats davant l&#8217;empresa i a vegades se&#8217;n diu la representaci\u00f3 unit\u00e0ria dels treballadors. Aquests delegats i membres del comit\u00e8 d&#8217;empresa tenen les mateixes funcions i garanties. Despr\u00e9s tamb\u00e9 poden existir altres figures, com els delegats de prevenci\u00f3 de riscos laborals, o els delegats sindicals.<\/p>\n<ul>\n<li class=\"first last\"><strong>Delegats de personal<\/strong><\/li>\n<\/ul>\n<p>Quan l&#8217;empresa t\u00e9 entre 10 i 49 treballadors, tindr\u00e0 com a representants als delegats de personal. Si l&#8217;empresa t\u00e9 entre 6 i 10 treballadors, aquests podran triar per majoria tenir un delegat si volen. Si l&#8217;empresa t\u00e9 menys de 30 treballadors, tindr\u00e0 1 delegat, si en tenen m\u00e9s en tindr\u00e0 3.<\/p>\n<ul>\n<li class=\"first last\"><strong>Comit\u00e8 d&#8217;empresa<\/strong><\/li>\n<\/ul>\n<p>Quan l&#8217;empresa t\u00e9 m\u00e9s treballadors, els representants formen un comit\u00e8 d&#8217;empresa. Aquest comit\u00e8 normalment representa a tots els treballadors de l&#8217;empresa o del centre de treball, si l&#8217;empresa en t\u00e9 varis. Per\u00f2 hi ha regles especials quan hi ha molts centres de treball petits per\u00f2 pr\u00f2xims. Igualment el conveni col\u00b7lectiu pot preveure un comit\u00e8 intercentres.<\/p>\n<p>El nombre de membres del comit\u00e8 d&#8217;empresa dependr\u00e0 del nombre de treballadors, entre 5 membres fins a 75.<\/p>\n<table>\n<tbody>\n<tr>\n<td>50-100 treballadors<\/td>\n<td>5 membres<\/td>\n<\/tr>\n<tr>\n<td>101-2015 treballadors<\/td>\n<td>9 membres<\/td>\n<\/tr>\n<tr>\n<td>251-500 treballadors<\/td>\n<td>13 membres<\/td>\n<\/tr>\n<tr>\n<td>501-750 treballadors<\/td>\n<td>17 membres<\/td>\n<\/tr>\n<tr>\n<td>751-1000 treballadors<\/td>\n<td>21 membres<\/td>\n<\/tr>\n<tr>\n<td>+ 1.000<\/td>\n<td>2 membres m\u00e9s per cada 1.000 treballadors, m\u00e0xim 75<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Entre els membres del comit\u00e8 es triar\u00e0 un president i un secretari, i el comit\u00e8 s&#8217;haur\u00e0 de reunir cada dos mesos, quan ho demani 1\/3 dels membres o quan ho demani 1\/3 dels treballadors.<\/p>\n<p><strong>Obligacions de l&#8217;empresa<\/strong><\/p>\n<p>Una vegada rebuda la notificaci\u00f3 dels promotors de les eleccions, la seva empresa t\u00e9 dues obligacions:<\/p>\n<ul>\n<li class=\"first last\">En un termini de set dies haur\u00e0 d&#8217;informar els treballadors que han de constituir la mesa electoral. Aquests empleats seran el m\u00e9s antic (que ser\u00e0 el president de la mesa), el de m\u00e9s edat (que ser\u00e0 vocal) i el de menys edat (que, a part de vocal, tamb\u00e9 ser\u00e0 el secretari).<\/li>\n<\/ul>\n<ul>\n<li class=\"first last\">Tamb\u00e9 haur\u00e0 de lliurar el cens laboral (la relaci\u00f3 d&#8217;empleats que treballen en la seva empresa) a la mesa electoral i facilitar els mitjans necessaris per al desenvolupament normal de les eleccions.
