{"id":8074,"date":"2019-10-16T00:00:00","date_gmt":"2019-10-16T00:00:00","guid":{"rendered":"https:\/\/centregestor.es\/elevacio-de-la-renda-per-millores-en-larrendament-dun-immoble\/"},"modified":"2020-11-17T22:56:03","modified_gmt":"2020-11-17T22:56:03","slug":"elevacio-de-la-renda-per-millores-en-larrendament-dun-immoble","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/elevacio-de-la-renda-per-millores-en-larrendament-dun-immoble\/","title":{"rendered":"Elevaci\u00f3 de la renda per millores en l&#8217;arrendament d&#8217;un immoble"},"content":{"rendered":"<p>Segons la LAU, l&#8217;arrendatari o inquil\u00ed ha de suportar la realitzaci\u00f3 d&#8217;obres de millora l&#8217;execuci\u00f3 de les quals no pugui diferir-se raonablement fins al final de l&#8217;arrendament. Seria el cas, per exemple, que la comunitat acord\u00e9s substituir la calefacci\u00f3 central per un sistema de calefacci\u00f3 individual. En aquest cas:<\/p>\n<ul>\n<li class=\"first\">Les obres que es realitzaran s&#8217;han de notificar a l&#8217;arrendatari, amb almenys tres mesos d&#8217;antelaci\u00f3, amb la seva durada i el cost pressupostat. L&#8217;arrendatari tindr\u00e0 un mes per a desistir del contracte (excepte si les obres no afecten de manera rellevant a l&#8217;habitatge).<\/li>\n<li class=\"last\">Si l&#8217;inquil\u00ed no desisteix, t\u00e9 dret a una reducci\u00f3 de renda proporcional a la part d&#8217;habitatge de la qual es vegi privat durant les obres. I si les obres obliguen l&#8217;arrendatari a realitzar altres despeses, tamb\u00e9 pot exigir que l&#8217;arrendador els aboni.<\/li>\n<\/ul>\n<p><strong>Elevaci\u00f3 de la renda per l&#8217;arrendador\/propietari<\/strong><\/p>\n<p>No obstant l&#8217;anterior, l&#8217;arrendatari t\u00e9 dret a augmentar la renda per millores si es compleixen determinats requisits.<\/p>\n<p>En concret, la LAU estableix que la realitzaci\u00f3 per l&#8217;arrendador d&#8217;obres de millora, transcorreguts 5 anys de durada del contracte, o 7 anys si l&#8217;arrendador fos persona jur\u00eddica, li donar\u00e0 dret, excepte pacte en contra, a elevar la renda anual en la quantia que resulti d&#8217;aplicar al capital invertit en la millora, el tipus d&#8217;inter\u00e8s legal dels diners en el moment de la terminaci\u00f3 de les obres incrementat en tres punts, sense que pugui excedir l&#8217;augment del 20% de la renda vigent en aquell moment.<\/p>\n<p>R\u00e8gim transitori de la norma:<\/p>\n<ul>\n<li class=\"first\">Si el contracte es va signar entre el 6 de juny del 2013 i el 18 de desembre del 2018, o entre el 24 de gener i el 5 de mar\u00e7 del 2019, pot incrementar la renda si han passat 3 anys de contracte, excepte si es va pactar el contrari.<\/li>\n<li class=\"last\">Si el contracte es va signar entre el 19 de desembre del 2018 i el 23 de gener del 2019, o a partir del 6 de mar\u00e7 del 2019, el termini sense poder incrementar la renda ser\u00e0 de 5 anys si l&#8217;arrendador \u00e9s persona f\u00edsica i de 7 si \u00e9s persona jur\u00eddica.<\/li>\n<\/ul>\n<p><strong>Atenci\u00f3.<\/strong>\u00a0Per al c\u00e0lcul del capital invertit, s&#8217;hauran de descomptar les subvencions p\u00fabliques obtingudes per a la realitzaci\u00f3 de l&#8217;obra.<\/p>\n<p>No es fa distinci\u00f3 entre obres de millora en els elements comuns o privatius. \u00c9s a dir, que les obres de millora poden afectar tant elements comuns com privatius. S&#8217;afegeix, aix\u00f2 s\u00ed, la precisi\u00f3 que quan la millora afecti diverses finques d&#8217;un edifici en r\u00e8gim de propietat horitzontal, l&#8217;arrendador haur\u00e0 de repartir proporcionalment entre totes elles el capital invertit, aplicant, a aquest efecte, les quotes de participaci\u00f3 que corresponguin a cadascuna d&#8217;aquelles.<\/p>\n<p>En el sup\u00f2sit d&#8217;edificis que no es trobin en r\u00e8gim de propietat horitzontal, el capital invertit es repartir\u00e0 proporcionalment entre les finques afectades per acord entre arrendador i arrendataris. A falta d&#8217;acord, es repartir\u00e0 proporcionalment en funci\u00f3 de la superf\u00edcie de la finca arrendada.<\/p>\n<p>El requisit que hagin transcorregut 5 anys de durada del contracte d&#8217;arrendament, o de 7 en cas de tractar-se d&#8217;un arrendador persona jur\u00eddica, cedeix davant l&#8217;acord de les parts de realitzar obres de millora en l&#8217;habitatge arrendat. En tot cas, l&#8217;abast de les obres de millora haur\u00e0 d&#8217;anar m\u00e9s enll\u00e0 del compliment del deure de conservaci\u00f3 per part de l&#8217;arrendador.<\/p>\n<p>L&#8217;arrendador est\u00e0 obligat a realitzar, sense dret a elevar per aix\u00f2 la renda, totes les reparacions que siguin necess\u00e0ries per a conservar l&#8217;habitatge en les condicions d&#8217;habitabilitat per a servir a l&#8217;\u00fas convingut, excepte quan la deterioraci\u00f3 de la reparaci\u00f3 de la qual es tracti sigui imputable a l&#8217;arrendatari.<\/p>\n<p><strong>Quan es produeix l&#8217;elevaci\u00f3 de la renda?<\/strong><\/p>\n<p>L&#8217;elevaci\u00f3 de renda es produir\u00e0 des del mes seg\u00fcent a aquell en qu\u00e8, ja finalitzades les obres, l&#8217;arrendador en notifiqui per escrit a l&#8217;arrendatari la quantia, detallant els c\u00e0lculs que condueixen a la seva determinaci\u00f3 i aportant c\u00f2pies dels documents dels quals resulti el cost de les obres realitzades.<\/p>\n<p>\u00a0<\/p>","protected":false},"excerpt":{"rendered":"<p>Segons la LAU, l&#8217;arrendatari o inquil\u00ed ha de suportar la realitzaci\u00f3 d&#8217;obres de millora l&#8217;execuci\u00f3 de les quals<\/p>","protected":false},"author":1,"featured_media":7414,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_joinchat":[],"footnotes":""},"categories":[],"tags":[],"class_list":["post-8074","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.7 -
