L’informem que els Ministeris de Treball i Economia Social i d’Inclusi\u00f3, Seguretat Social i Migracions han acordat amb data de 25 de juny, en el marc del di\u00e0leg social, amb els agents socials les noves condicions que permetran\u00a0d’estendre els beneficis dels ERTO fins al pr\u00f2xim 30 de setembre<\/strong>.<\/p>\n

L’acord, que es traslladar\u00e0 a la reuni\u00f3 del Consell de Ministres del 26 de juny, preveu beneficis en les cotitzacions a la Seguretat Social dels treballadors, garanties per al manteniment de l’ocupaci\u00f3 i mecanismes de flexibilitat perqu\u00e8 les empreses s’adaptin als nous escenaris segons evolucioni la crisi sanit\u00e0ria.<\/p>\n

Exoneracions de quotes<\/strong><\/p>\n

L’acord inclou diferents exoneracions per a les empreses, segons la seva situaci\u00f3. En el cas de les empreses que estan en situaci\u00f3 de for\u00e7a major parcial, l’acord fins a setembre mant\u00e9 l’esperit del vigent, bonificant m\u00e9s les cotitzacions dels treballadors activats que dels suspesos.<\/p>\n

D’aquesta manera, per a empreses amb menys de 50 treballadors tindran una exoneraci\u00f3 del 60% de les cotitzacions socials dels seus treballadors activats en els mesos de juliol, agost i setembre i del 35% per als treballadors que continu\u00efn suspesos.<\/p>\n

Per a les empreses de 50 o m\u00e9s treballadors, les exoneracions seran del 40% per als treballadors activats i del 25% per als no activats.<\/p>\n

D’altra banda, les empreses que estan actualment en ERTO per for\u00e7a major total passaran a ERTO de transici\u00f3 fins al 30 de setembre. Dins d’elles, les que compten amb menys de 50 treballadors tindran una exoneraci\u00f3 decreixent en les cotitzacions dels seus empleats del 70%, 60% i 35% al juliol, agost i setembre, respectivament. Per a les empreses de 50 treballadors o m\u00e9s, les exoneracions passarien a ser del 50%, 40% i 25%, al juliol, agost i setembre, respectivament.<\/p>\n

Aquests ERTO es tramitaran comptant amb l’informe preceptiu de la Inspecci\u00f3 de Treball i despr\u00e9s d’haver informat els representants legals dels treballadors, tal com regula l’article 47 de l’Estatut dels Treballadors<\/a>.<\/p>\n

Salvaguarda per a l’ocupaci\u00f3<\/strong><\/p>\n

Les empreses que s’acullin a les exoneracions previstes en cas d’ERTO, hauran de mantenir l’ocupaci\u00f3 durant un per\u00edode de sis mesos.<\/p>\n

Durant un ERTO en vigor, les empreses no podran efectuar acomiadaments i tampoc podran repartir dividends. Queden fora de l’\u00e0mbit d’aplicaci\u00f3 d’aquests ERTO les empreses radicades en paradisos fiscals.<\/p>\n

Els treballadors de les empreses que s’acullin a aquests ERTO no podran realitzar hores extra. No estar\u00e0 perm\u00e8s que les empreses concertin noves contractacions laborals, directes o a trav\u00e9s d’ETT, ni que estableixin noves externalitzacions, durant la vig\u00e8ncia dels ERTO.<\/p>\n

Protecci\u00f3 per desocupaci\u00f3<\/strong><\/p>\n

Els treballadors afectats per expedients de regulaci\u00f3 temporal d’ocupaci\u00f3 derivats de la Covid-19, tant de for\u00e7a major total o parcial com basats en causes productives o els tramitats en cas de rebrot, gaudiran de la protecci\u00f3 refor\u00e7ada prevista en l’anterior acord: se’ls reconeixer\u00e0 la prestaci\u00f3 encara que no acreditin per\u00edode de cotitzaci\u00f3 previ i se’ls aplicar\u00e0 el comptador a 0.<\/p>","protected":false},"excerpt":{"rendered":"
