L’informem que s’ha publicat una important sent\u00e8ncia del TJUE de 15 de maig de 2020 amb assumptes acumulats C-224\/19, C-259\/19, sobre el pagament de les despeses hipotec\u00e0ries (derivades de la formalitzaci\u00f3 dels pr\u00e9stecs hipotecaris, com s\u00f3n notari, registre, gestoria, taxaci\u00f3 i impostos) que derivin de la declaraci\u00f3 com a abusiva d’una cl\u00e0usula d’aquest contracte, i sobre la comissi\u00f3 d’obertura o costes dels judicis.<\/p>\n

Per al TJUE les quantitats pagades en concepte de despeses d’hipoteca que estiguin incloses en una cl\u00e0usula declarada abusiva han de ser retornades al consumidor tret que el dret nacional estableixi el contrari. Si es declara com a nul\u00b7la una cl\u00e0usula abusiva que carrega al client amb el pagament de totes les despeses de constituci\u00f3 i cancel\u00b7laci\u00f3 d’una hipoteca, el dret comunitari s’oposa al fet que el jutge nacional negui al consumidor la devoluci\u00f3 de les quantitats pagades en virtut d’aquesta cl\u00e0usula.<\/p>\n

La sent\u00e8ncia aborda el moment de l’inici del termini de prescripci\u00f3 per reclamar la devoluci\u00f3. Amb un termini de cinc anys, el tribunal no s’oposa al fet que existeixi un termini, \u00absempre que ni el moment en qu\u00e8 aquest termini comen\u00e7a a comptar ni la seva durada facin impossible en la pr\u00e0ctica o excessivament dif\u00edcil l’exercici del dret del consumidor a sol\u00b7licitar la restituci\u00f3\u00bb. I tamb\u00e9 resol que no es pot carregar als clients una part de les costes processals derivades de les reclamacions contra els bancs en via judicial.<\/p>","protected":false},"excerpt":{"rendered":"
