{"id":8150,"date":"2020-09-17T00:00:00","date_gmt":"2020-09-17T00:00:00","guid":{"rendered":"https:\/\/centregestor.es\/nota-informativa-de-la-inspeccio-de-treball-sobre-la-tramitacio-dels-erto-per-forca-major\/"},"modified":"2020-11-17T22:56:45","modified_gmt":"2020-11-17T22:56:45","slug":"nota-informativa-de-la-inspeccio-de-treball-sobre-la-tramitacio-dels-erto-per-forca-major","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/nota-informativa-de-la-inspeccio-de-treball-sobre-la-tramitacio-dels-erto-per-forca-major\/","title":{"rendered":"Nota informativa de la Inspecci\u00f3 de Treball sobre la tramitaci\u00f3 dels ERTO per for\u00e7a major"},"content":{"rendered":"<p>L&#8217;informem que el\u00a0<strong>30 de setembre (excepte nova pr\u00f2rroga) finalitzar\u00e0 la pr\u00f2rroga de la prestaci\u00f3 extraordin\u00e0ria de cessament d&#8217;activitat<\/strong>\u00a0que es va aprovar pel RDL 24\/2020, en el qual tamb\u00e9 es recull l&#8217;exempci\u00f3 de la cotitzaci\u00f3 a la Seguretat Social per als qui percebessin aquesta prestaci\u00f3 extraordin\u00e0ria. Aquests treballadors no van pagar la quota de juliol, van tenir una exempci\u00f3 del 50% a l&#8217;agost i en aquest mes de setembre, ser\u00e0 del 25%, i pagaran la quota \u00edntegra el mes d&#8217;octubre. En aquest RDL 24\/2020 tamb\u00e9 es va recollir una nova ajuda per als denominats \u00abaut\u00f2noms de temporada\u00bb, que s&#8217;havien quedat fora de l&#8217;anterior prestaci\u00f3.<\/p>\n<p>Recordem que els beneficiaris de la prestaci\u00f3 extraordin\u00e0ria poden sol\u00b7licitar la prestaci\u00f3 ordin\u00e0ria per cessament d&#8217;activitat, si acrediten una reducci\u00f3 de la facturaci\u00f3 del 75% del tercer trimestre d&#8217;enguany en comparaci\u00f3 amb el mateix trimestre de l&#8217;any anterior (per a aix\u00f2 no es necessitar\u00e0 esperar la finalitzaci\u00f3 del trimestre: es podr\u00e0 sol\u00b7licitar la prestaci\u00f3 ordin\u00e0ria si s&#8217;estima el compliment dels requisits, que s&#8217;acreditaran de manera documental despr\u00e9s d&#8217;aquest trimestre).<\/p>\n<p>En el cas dels aut\u00f2noms que tinguin un treballador o m\u00e9s a c\u00e0rrec seu, s&#8217;haur\u00e0 d&#8217;acreditar en el moment de sol\u00b7licitar la prestaci\u00f3 el compliment de totes les obligacions laborals i de Seguretat Social que tinguin assumides. Per a aix\u00f2 emetran una declaraci\u00f3 responsable, i poden ser requerits per les m\u00fatues col\u00b7laboradores amb la Seguretat Social o per l&#8217;entitat gestora perqu\u00e8 aportin els documents necessaris.<\/p>\n<p>Tamb\u00e9 hauran de pagar aquells aut\u00f2noms que van demanar una morat\u00f2ria en el pagament de les quotes a la Seguretat Social, d&#8217;acord amb l&#8217;article 34 del RDL 11\/2020, de 31 de mar\u00e7, en el qual s&#8217;establia \u00ab<em>atorgar morat\u00f2ries de sis mesos, sense inter\u00e8s, a les empreses i als treballadors per compte propi inclosos en qualsevol r\u00e8gim de la Seguretat Social, sempre que les activitats que realitzin no s&#8217;hagin susp\u00e8s amb la declaraci\u00f3 de l&#8217;estat d&#8217;alarma i es compleixin els requisits de l&#8217;OM ISM\/371\/2020, de 24 d&#8217;abril<\/em>\u00bb.<\/p>\n<p>Amb aquest acord es volia donar un respir almenys fins a l&#8217;octubre per compensar les possibles p\u00e8rdues dels aut\u00f2noms a l&#8217;estiu. No obstant aix\u00f2, donat l&#8217;augment dels rebrots i contagis, s&#8217;ha continuat restringint l&#8217;activitat dels aut\u00f2noms.
