{"id":9550,"date":"2020-05-21T23:00:15","date_gmt":"2020-05-21T23:00:15","guid":{"rendered":"https:\/\/centregestor.es\/?p=9550"},"modified":"2020-12-01T23:13:52","modified_gmt":"2020-12-01T23:13:52","slug":"obligatorio-el-uso-de-las-mascarillas-2","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/obligatorio-el-uso-de-las-mascarillas-2\/","title":{"rendered":"Obligatorio el uso de las mascarillas"},"content":{"rendered":"<p>El Bolet\u00edn Oficial del Estado ha publicado <u>l<\/u>a <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2020-5142\">norma<\/a> por la que\u00a0se establece el uso obligatorio de mascarillas.\u00a0<strong>A partir de hoy jueves 21 de mayo<\/strong>, las mascarillas ser\u00e1n de uso obligado en la v\u00eda p\u00fablica con el objetivo de reducir la transmisio\u0301n comunitaria del coronavirus. Unas mascarillas que, como explica el BOE, ser\u00e1n obligatorias por haber demostrado \u00abla capacidad para bloquear la emisi\u00f3n de gotas infectadas\u00bb.<\/p>\n<p><strong>\u00bfEn qu\u00e9 sitios hay que llevarla?<\/strong><\/p>\n<p>La orden establece, con car\u00e1cter general, que se deber\u00e1 llevar mascarilla en la v\u00eda p\u00fablica y en espacios abiertos, siempre que no sea posible mantener al menos los dos metros de seguridad. Es decir, la mascarilla ser\u00e1 obligatoria\u00a0<strong>en la calle, pero tambi\u00e9n espacios de uso p\u00fablico<\/strong>\u00a0como bibliotecas, escuelas, hospitales, ayuntamientos, estaciones o los jardines, playas, parques y espacios naturales, cuyo suelo es de propiedad p\u00fablica.<\/p>\n<p><strong>\u00bfQui\u00e9n tendr\u00e1 que llevarla?<\/strong><\/p>\n<p>\u00abQuedan obligados al uso de mascarillas en los espacios se\u00f1alados\u00a0<strong>las personas de seis a\u00f1os en adelante<\/strong>, en cualquier espacio cerrado de uso p\u00fablico o que se encuentre abierto al p\u00fablico, siempre que no sea posible mantener una distancia de seguridad interpersonal de al menos dos metros\u00bb.<\/p>\n<p><strong>\u00bfQu\u00e9 se considera mascarilla?<\/strong><\/p>\n<p>El art\u00edculo 1 del BOE, considera que el objeto a regular es la mascarilla. As\u00ed lo explica la normativa:<\/p>\n<p><em>\u00abA los efectos de lo dispuesto en la presente orden, se entender\u00e1 cumplida la obligaci\u00f3n a que se refiere el apartado anterior mediante el uso de\u00a0<strong>cualquier tipo de mascarilla, preferentemente higi\u00e9nicas y quir\u00fargicas, que cubra nariz y boca<\/strong>. Se observar\u00e1n, en todo caso, las indicaciones de las autoridades sanitarias acerca de su uso\u00bb.<\/em><\/p>\n<p>\u00bf<strong>Qu\u00e9 excepciones se contemplan?<\/strong><\/p>\n<p>Si bien el uso de la mascarilla es obligatorio en la v\u00eda p\u00fablica, s\u00ed se contemplan una serie de excepciones tanto de actividades como de personas que est\u00e1n exentas. En concreto aquellas personas que tengan alg\u00fan tipo de dificultad respiratoria y en aquellas circunstancias de fuerza mayor.<\/p>\n<ul>\n<li><strong>\u00abPersonas que presenten alg\u00fan tipo de dificultad respiratoria<\/strong>que pueda verse agravada por el uso de mascarilla\u00bb.<\/li>\n<li>\u00abPersonas en las que el uso de mascarilla resulte contraindicado por\u00a0<strong>motivos de salud debidamente justificados<\/strong>, o que por su situaci\u00f3n de discapacidad o dependencia presenten alteraciones de conducta que hagan inviable su utilizaci\u00f3n\u00bb.<\/li>\n<li>\u00abCausa de fuerza mayor o situaci\u00f3n de necesidad\u00bb.<\/li>\n<li>\u00abDesarrollo de actividades en las que, por la propia naturaleza de estas, resulte incompatible el uso de la mascarilla\u00bb.<\/li>\n<\/ul>\n<p><strong>\u00bfEs obligatoria la mascarilla al hacer deporte?<\/strong><\/p>\n<p>Seg\u00fan indica el BOE se podr\u00e1 prescindir de la protecci\u00f3n durante el \u00abdesarrollo de actividades en las que, por la propia naturaleza de estas, resulte incompatible el uso de la mascarilla\u00bb; o por \u00abcausa de fuerza mayor o situaci\u00f3n de necesidad\u00bb.<\/p>\n<p><strong>\u00bfY en el coche?<\/strong><\/p>\n<p>El\u00a0<a href=\"https:\/\/boe.es\/boe\/dias\/2020\/05\/03\/pdfs\/BOE-A-2020-4789.pdf#boen\">pasado 4 de mayo<\/a>, el BOE ya estableci\u00f3 que las mascarillas son de uso obligado en los coches en los que viajen personas que no convivan, un caso que tambi\u00e9n aplica al transporte p\u00fablico. La normativa \u00abmantendr\u00e1 su eficacia durante toda la vigencia del estado de alarma y sus posibles pr\u00f3rrogas\u00bb.<\/p>\n<p><strong>\u00bfQu\u00e9 sanciones hay sin se incumple con la obligaci\u00f3n?<\/strong><\/p>\n<p>Seg\u00fan la Ley de Seguridad Ciudadana se establece que las sanciones graves est\u00e1n sancionadas de 30.001 a 600.000 euros, las graves de 601 a 30.000 euros y las leves, con multa de 100 a 600 euros.
