{"id":9569,"date":"2020-03-24T23:00:22","date_gmt":"2020-03-24T23:00:22","guid":{"rendered":"https:\/\/centregestor.es\/?p=9569"},"modified":"2020-12-01T23:04:34","modified_gmt":"2020-12-01T23:04:34","slug":"como-afecta-el-erte-por-fuerza-mayor-a-los-trabajadores-2","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/como-afecta-el-erte-por-fuerza-mayor-a-los-trabajadores-2\/","title":{"rendered":"Como afecta el ERTE por fuerza mayor a los trabajadores"},"content":{"rendered":"<ul>\n<li>Un EXPEDIENTE DE REGULACION DE EMPLEO TEMPORAL (ERTE) es una medida excepcional que consiste en la SUSPENSION del contrato de trabajo en un periodo concreto, en este especial caso, mientras perdure la situaci\u00f3n o causa de FUERZA MAYOR generada por el COVID-19.<\/li>\n<li>El ERTE afecta, normalmente, a toda la plantilla, si bien se adapta a la situaci\u00f3n espec\u00edfica de cada empresa y sus circunstancias (guardias, urgencias, secciones) por lo que la afectaci\u00f3n puede variar dependiendo del puesto de trabajo en particular de cada trabajador.<\/li>\n<li>El ERTE afecta a los trabajadores en situaci\u00f3n de INCAPACIDAD TEMPORAL. Mientras siguen de baja m\u00e9dica no les afecta, dado que el contrato ya se encuentra suspendido por la baja m\u00e9dica. En caso de que les den el Alta m\u00e9dica durante el periodo de vigencia del ERTE pasar\u00e1n a percibir el subsidio de desempleo desde el d\u00eda siguiente al Alta m\u00e9dica, afectados por el ERTE.<\/li>\n<li>Durante los d\u00edas en que est\u00e9 el trabajador afectado por el ERTE percibir\u00e1 la prestaci\u00f3n por desempleo, sea cual sea el periodo de cotizaci\u00f3n que tenga el trabajador (novedad del R.D. 8\/2020 de 18 de marzo). La cantidad a percibir es el 70% de la base de cotizaci\u00f3n a la Seg. Social (que se calcula con el promedio de los 6 \u00faltimos meses) y con el tope bruto de <strong>098,09 euros (sin hijos); 1.254,96 euros (1 hijo a cargo); 1.411,83 (2 o m\u00e1s hijos a cargo).<\/strong><\/li>\n<li>La empresa debe comunicar al trabajador por mail, WhatsApp o cualquier otro medio, tanto la presentaci\u00f3n del expediente como la posterior aprobaci\u00f3n del mismo por la Autoridad Laboral, as\u00ed como que afectaci\u00f3n personal le supone al trabajador (si debe trabajar por circunstancias especiales) o si permanece sin trabajar afectado por el ERTE.<\/li>\n<li>Una vez se le ha comunicado la aprobaci\u00f3n del ERTE al trabajador este debe gestionar su solicitud de alta al SEPE o SOC por medios telef\u00f3nicos o telem\u00e1ticos, a la p\u00e1gina:<\/li>\n<\/ul>\n<p><a href=\"https:\/\/sede.sepe.gob.es\/portalSedeEstaticos\/flows\/gestorContenidos?page=cb00\">https:\/\/sede.sepe.gob.es\/portalSedeEstaticos\/flows\/gestorContenidos?page=cb00<\/a><\/p>\n<p><a href=\"https:\/\/www.sepe.es\/direccionesytelefonosWeb\/ActionBuscarDireccionesytelefonosId.do?id=12512015\">https:\/\/www.sepe.es\/direccionesytelefonosWeb\/ActionBuscarDireccionesytelefonosId.do?id=12512015<\/a><\/p>\n<p>Tel\u00e9fono Oficina Lleida: 973990598 \/ 901119999<\/p>\n<ul>\n<li>La documentaci\u00f3n para presentar es: DNI o NIE \/ documento bancario con n\u00famero de cuenta y titular \/ Libro de Familia.<\/li>\n<li>De forma excepcional puede ser que, en pr\u00f3ximos d\u00edas, se establezca alg\u00fan sistema de comunicaci\u00f3n especial a trav\u00e9s de sistemas telem\u00e1ticos gestionados por la propia empresa.<\/li>\n<li>La prestaci\u00f3n derivada del ERTE NO consume la prestaci\u00f3n contributiva de desempleo que pueda generarse con posterioridad una vez superada la situaci\u00f3n y tampoco consume d\u00edas de la prestaci\u00f3n que se pudiera tener reconocida con anterioridad.<\/li>\n<li>En el ERTE por fuerza mayor NO hay indemnizaci\u00f3n para el trabajador.
