{"id":9704,"date":"2019-11-19T21:39:07","date_gmt":"2019-11-19T21:39:07","guid":{"rendered":"https:\/\/centregestor.es\/?p=9704"},"modified":"2020-12-02T21:43:37","modified_gmt":"2020-12-02T21:43:37","slug":"el-registro-horario-objetivo-prioritario-para-2020-2","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/el-registro-horario-objetivo-prioritario-para-2020-2\/","title":{"rendered":"El registro horario objetivo prioritario para 2020"},"content":{"rendered":"<p>Este mes de noviembre el Ministerio de Trabajo ha informado que, para reforzar y aumentar las actuaciones llevadas a cabo en estos seis meses, la Inspecci\u00f3n de trabajo y la Seguridad Social, en coordinaci\u00f3n con las comunidades aut\u00f3nomas, van a poner en marcha el pr\u00f3ximo a\u00f1o 2020 una nueva campa\u00f1a de inspecci\u00f3n espec\u00edfica sobre el registro horario.<\/p>\n<p>Tras las primeras inspecciones centradas en el registro horario, s\u00e9 detect\u00f3 que m\u00e1s de la mitad de las empresas inspeccionadas\u00a0durante los seis primeros meses de vigencia no registraron adecuadamente los marcajes.<\/p>\n<p>Seg\u00fan se desprende del primer balance de la Inspecci\u00f3n de Trabajo y la Seguridad Social sobre la normativa, se detectaron infracciones en 107 de las 505 compa\u00f1\u00edas sometidas a una revisi\u00f3n, esto es, en el\u00a021,2 %, aunque a otras 189 se les ha pedido que subsanen errores.<\/p>\n<p>La obligaci\u00f3n de registrar diariamente la jornada laboral\u00a0es aplicable a todos los empleados, al margen de su categor\u00eda o grupo profesional, y en todos los sectores, incluyendo al teletrabajo y otras f\u00f3rmulas de horario flexible o trabajadores m\u00f3viles, aunque existen algunas excepciones en determinadas relaciones laborales de car\u00e1cter especial, como el personal de alta direcci\u00f3n.<\/p>\n<p>Trabajo amenaz\u00f3 con que iba ser muy exigente y neg\u00f3 las exenciones que le reclamaban abogados, agricultores, la flota pesquera, los editores de prensa, las pymes y los aut\u00f3nomos societarios. Ante las quejas y las preguntas constantes que recib\u00eda, public\u00f3 una <a href=\"http:\/\/www.mitramiss.gob.es\/ficheros\/ministerio\/GuiaRegistroJornada.pdf\">Gu\u00eda<\/a> que intentaba rellenar las lagunas del Decreto.<\/p>\n<p>De este modo, aclar\u00f3 que s\u00f3lo est\u00e1n exentos de realizar el registro horario los cargos de alta direcci\u00f3n y los aut\u00f3nomos. Esto no exim\u00eda al personal con responsabilidades y a mandos intermedios, ni tampoco a los aut\u00f3nomos con un peque\u00f1o n\u00famero de trabajadores a su cargo, los aut\u00f3nomos societarios, como exig\u00eda ATS.<\/p>\n<p>La nota de Trabajo explica que, adem\u00e1s de las inspecciones del registro\u00a0horario, en el mismo per\u00edodo se han llevado a t\u00e9rmino\u00a0otras 4.858 inspecciones en el marco de la campa\u00f1a anual sobre tiempo de trabajo, de las que se han efectuado 1.482 requerimientos de subsanaci\u00f3n y\u00a0se han denunciado 873 infracciones, por un importe total de 1,15 millones de euros.<\/p>\n<p>\u00abEn las actuaciones de esta campa\u00f1a se ha revisado la existencia del registro de jornada y \u00e9ste se ha utilizado como medio de prueba para la realizaci\u00f3n de la actuaci\u00f3n inspectora\u00bb, explica la nota. De esta forma,\u00a0sumando ambos tipos de inspecciones, entre mayo y octubre se han finalizado 5.363 expedientes, con 980 infracciones, un 18,3 %, por las que se han solicitado para las empresas infractoras\u00a0multas por valor de 1,26 millones de euros en total.<\/p>\n<p>Cuando pasaron las primeras semanas, el Ministerio ya traslad\u00f3 que no se realizar\u00edan inspecciones concretas hasta la vuelta del verano, lo que no ha sucedido. Los datos publicados este mes de noviembre han analizado esta nueva obligaci\u00f3n en el marco de las inspecciones en materia de tiempo de trabajo.<\/p>\n<p>El registro ser\u00e1 objetivo prioritario desde enero, anunci\u00f3 Magdalena Valerio que se\u00f1al\u00f3, adem\u00e1s,\u00a0que\u00a0la Inspecci\u00f3n de Trabajo y Seguridad Social tiene previsto \u00abreforzar y aumentar\u00bb las inspecciones con una campa\u00f1a espec\u00edfica sobre el registro horario.<\/p>\n<p>Habr\u00e1 margen desde la entrada en vigor para ver si las horas extra no retribuidas se compensan con libranzas, como exige la norma para que no se cometa infracci\u00f3n.<\/p>","protected":false},"excerpt":{"rendered":"<p>Este mes de noviembre el Ministerio de Trabajo ha informado que, para reforzar y aumentar las actuaciones llevadas<\/p>","protected":false},"author":1,"featured_media":7432,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_joinchat":[],"footnotes":""},"categories":[2301],"tags":[],"class_list":["post-9704","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-sin-categorizar-ca"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.7 -
