{"id":9816,"date":"2019-03-12T22:23:17","date_gmt":"2019-03-12T22:23:17","guid":{"rendered":"https:\/\/centregestor.es\/?p=9816"},"modified":"2020-12-03T22:24:26","modified_gmt":"2020-12-03T22:24:26","slug":"reforma-del-reglamento-de-ordenacion-de-los-transportes-terrestres-rott-2","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/reforma-del-reglamento-de-ordenacion-de-los-transportes-terrestres-rott-2\/","title":{"rendered":"Reforma del Reglamento de Ordenaci\u00f3n de los Transportes Terrestres (ROTT)"},"content":{"rendered":"<p>Apreciado\/a cliente,<\/p>\n<p>El pasado mi\u00e9rcoles 20 de febrero el Bolet\u00edn Oficial del Estado public\u00f3 la modificaci\u00f3n del Reglamento de Ordenaci\u00f3n de los Transportes Terrestres (ROTT).<\/p>\n<p>Debido a la envergadura de la reforma le aconsejamos que se ponga en contacto con el \u00e1rea de transportes y de esta forma diagnosticar el alcance que puede tener la reforma en su empresa. Le hacemos llegar mediante esta carta un resumen de las 10 modificaciones del reglamento que consideramos m\u00e1s importantes:<\/p>\n<ul>\n<li>Acceso a una autorizaci\u00f3n de transporte de mercanc\u00edas de servicio p\u00fablico con un \u00fanico veh\u00edculo de m\u00e1s de 3,5 toneladas de MMA con menos de cinco meses de antig\u00fcedad (en propiedad, arrendamiento financiero u ordinario).<\/li>\n<li>En caso de comprar un veh\u00edculo que necesite incorporar a la autorizaci\u00f3n de transporte p\u00fablico de mercanc\u00edas ya existente, as\u00ed como la sustituci\u00f3n de alguno de los que se haya adscrito seguir\u00e1 la regla que la antig\u00fcedad media de la flota adscrita a la autorizaci\u00f3n despu\u00e9s de la incorporaci\u00f3n del nuevo veh\u00edculo o la sustituci\u00f3n de uno de los que se encontraban adscritos, no podr\u00e1 superar la que dicha flota ten\u00eda antes de la nueva adscripci\u00f3n o sustituci\u00f3n.<\/li>\n<li>Las autorizaciones de servicio p\u00fablico que amparen veh\u00edculos de transporte de mercanc\u00edas que tengan una MMA autorizada superior a 3,5 toneladas de MMA, pero con su capacidad de carga limitada a 3.500 kilos, se convierten autom\u00e1ticamente en autorizaciones de pesado.<\/li>\n<li><strong>La p\u00e9rdida de la honorabilidad,<\/strong> y la consecuente suspensi\u00f3n de la autorizaci\u00f3n de transporte durante un a\u00f1o, directamente por la comisi\u00f3n de determinadas infracciones muy graves o indirectamente, por la acumulaci\u00f3n de infracciones de otras infracciones muy graves y graves, que se van a registrar en el nuevo \u00cdndice de Reiteraci\u00f3n Infractora (IRI).<\/li>\n<\/ul>\n<p><strong>Sanciones m\u00e1s comunes cuya comisi\u00f3n afecta al cumplimiento del requisito de honorabilidad:<\/strong><\/p>\n<ul>\n<li>La manipulaci\u00f3n del tac\u00f3grafo, limitador de velocidad<\/li>\n<li>La realizaci\u00f3n de transportes p\u00fablicos o privados utilizando conductores que carezcan del permiso de conducci\u00f3n adecuado o del CAP en vigor.<\/li>\n<li>Para tractoras N3 exceso superior al 20 % Para veh\u00edculos de PMA entre 3.500 Kg y 7.500 Kg. Exceso peso superior al 25%.<\/li>\n<li>Exceso igual o superior al cincuenta por ciento en los tiempos de conducci\u00f3n diaria.<\/li>\n<li>Exceso igual o superior al 25% en los tiempos m\u00e1ximos de conducci\u00f3n semanal o bisemanal.<\/li>\n<li>Conducir un veh\u00edculo que no haya superado la ITV.<\/li>\n<li>Falta de mantenimiento de las condiciones de seguridad del veh\u00edculo<\/li>\n<li><strong>Cambia el baremo sancionador:<\/strong> Se endurecen las multas por exceso de peso y se sanciona la realizaci\u00f3n del descanso semanal normal utilizando la cabina del veh\u00edculo.<\/li>\n<li>Se articula la figura del <strong>gestor de transporte<\/strong>, el actual capacitado, que debe tener una vinculaci\u00f3n real y efectiva con la empresa. Se deber\u00e1 estar dado de alta definen sus responsabilidades.<\/li>\n<li>Para la obtenci\u00f3n del certificado de competencia profesional como requisito para concurrir al examen es necesario disponer de un nivel m\u00ednimo de estudios: <strong>bachillerato o FP equivalente<\/strong>.<\/li>\n<li><strong>La desaparici\u00f3n de la Tarjeta de Transporte<\/strong> <strong>como documento acreditativo<\/strong> de la correspondiente autorizaci\u00f3n.
