{"id":9883,"date":"2018-12-04T15:17:41","date_gmt":"2018-12-04T15:17:41","guid":{"rendered":"https:\/\/centregestor.es\/?p=9883"},"modified":"2020-12-04T15:18:29","modified_gmt":"2020-12-04T15:18:29","slug":"implicaciones-de-la-reforma-laboral-en-el-rgpd-para-fichar-en-el-trabajo-2","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/implicaciones-de-la-reforma-laboral-en-el-rgpd-para-fichar-en-el-trabajo-2\/","title":{"rendered":"Implicaciones de la reforma laboral en el RGPD para fichar en el trabajo"},"content":{"rendered":"<p>La reforma laboral elaborada por el Gobierno incluye como novedad la obligaci\u00f3n para las empresas a que sus empleados deban fichar tanto a la entrada como a la salida de sus trabajos. Con esta medida se pretende modificar la actual regulaci\u00f3n del registro horario para\u00a0que el Estatuto de los Trabajadores garantice el derecho de cada empleado a conocer el horario, la duraci\u00f3n y la distribuci\u00f3n de su jornada laboral.<\/p>\n<p>En cualquier caso, la propuesta del Gobierno necesitar\u00e1 el respaldo parlamentario para salir adelante. El texto propuesto por el Ejecutivo propone la modificaci\u00f3n de los art\u00edculos 4, 12, 34 y 35 del Estatuto de Trabajadores y otro art\u00edculo m\u00e1s de la Ley de Infracciones y Sanciones en el Orden Social.<\/p>\n<p>La ley que regula el mercado de trabajo especificar\u00e1 en el art\u00edculo 34 del citado Estatuto c\u00f3mo deber\u00e1n registrar la jornada las empresas. El registro de jornada se deber\u00e1 efectuar diariamente incluyendo el horario concreto de entrada y salida, seg\u00fan indica el borrador legal del Ejecutivo. Otra novedad, incluida en el art\u00edculo 35, ser\u00e1 que, adem\u00e1s de que cada trabajador reciba mensualmente la relaci\u00f3n de horas ordinarias y extraordinarias que ha realizado en dicho mes, tambi\u00e9n los representantes sindicales recibir\u00e1n esta informaci\u00f3n de toda la plantilla.<\/p>\n<p>En relaci\u00f3n a las horas extras, el empresario tendr\u00e1 la obligaci\u00f3n de informar mensualmente al os representantes de los trabajadores sobre las horas extraordinarios que haya hecho el empleado, independientemente de su compensaci\u00f3n, obligando a la empresa a enviarles \u201ccopia de los res\u00famenes\u201d del registro diario. \u00a0Adem\u00e1s, la empresa deber\u00e1 conservar durante cuatro a\u00f1os los registros de jornada y permanecer en todo momento en el centro de trabajo a disposici\u00f3n de la Inspecci\u00f3n de Trabajo y de Seguridad Social.<\/p>\n<p>A trav\u00e9s de la nueva redacci\u00f3n del art\u00edculo 12 del Estatuto, que regula el empleo a tiempo parcial, \u201cse concretar\u00e1 de forma expresa en el contrato el horario habitual de trabajo, sin que sea suficiente a estos efectos la mera referencia al convenio colectivo de aplicaci\u00f3n\u201d.<\/p>\n<p>La propuesta del Gobierno concluye con otro cambio normativo que\u00a0aborda la nueva redacci\u00f3n del art\u00edculo 7 de la Ley de Infracciones y Sanciones en el Orden Social. En ella se establece que cuando un empresario no cumpla con la norma en materia de registro de jornada \u201cse entender\u00e1 que el empresario incurre en\u00a0una infracci\u00f3n por cada trabajador afectado\u201d.<\/p>\n<p><strong>\u00bfQu\u00e9 implicaciones tiene en el RGPD?<\/strong><\/p>\n<p>Ante la necesidad de una empresa de controlar que sus trabajadores trabajen las horas establecidas por convenio, puede obligarlos a fichar, tanto al entrar como al salir del trabajo.<\/p>\n<p>Cabe considerar que, si el sistema que decide implantar es el de huella dactilar, que es el m\u00e1s com\u00fan en estos casos, deber\u00e1 atender algunas consideraciones.<\/p>\n<p>La huella dactilar es un dato personal \u201cbiom\u00e9trico\u201d, y dado que este tipo de datos se consideran sensibles y est\u00e1n especialmente protegidos, si la utiliza como forma de identificaci\u00f3n deber\u00e1 cumplir la normativa de protecci\u00f3n de datos.<\/p>\n<p>En la nueva RGPD, es el articulo 9 el que indica la prohibici\u00f3n de utilizar datos biom\u00e9tricos, exceptuando varios casos, uno de ellos, en el punto b, que permitir\u00eda la utilizaci\u00f3n de datos biom\u00e9tricos con la finalidad de control de presencia para la verificaci\u00f3n del cumplimiento de un contrato laboral.<\/p>\n<p>Poseer datos biom\u00e9tricos, no implica que estemos obligados a tomar las mayores medidas de seguridad actualmente existentes, lo que si implica es, la necesidad de tomar medidas de protecci\u00f3n adicionales seg\u00fan el volumen de datos, y la finalidad para los que vayan a ser utilizados.<\/p>\n<p>Como siempre estamos a su disposici\u00f3n para ampliar la informaci\u00f3n que precise y realizar los tr\u00e1mites preceptivos que solicite.
