{"id":9953,"date":"2018-07-08T16:03:24","date_gmt":"2018-07-08T16:03:24","guid":{"rendered":"https:\/\/centregestor.es\/?p=9953"},"modified":"2020-12-04T16:03:39","modified_gmt":"2020-12-04T16:03:39","slug":"factura-electronica-obligatoria-para-subcontratistas-autonomos-y-pymes-2","status":"publish","type":"post","link":"https:\/\/centregestor.es\/ca\/factura-electronica-obligatoria-para-subcontratistas-autonomos-y-pymes-2\/","title":{"rendered":"Factura electr\u00f3nica obligatoria para subcontratistas aut\u00f3nomos y pymes"},"content":{"rendered":"<p>El 1 de marzo de este mismo a\u00f1o, 2018, entr\u00f3 en vigor la nueva <a href=\"https:\/\/www.boe.es\/buscar\/pdf\/2017\/BOE-A-2017-12902-consolidado.pdf\">Ley de Contrataci\u00f3n P\u00fablica<\/a> que tiene como objetivo promover la transparencia y la simplificaci\u00f3n de procesos, mediante el uso de los medios electr\u00f3nicos.<\/p>\n<p><strong>Esta nueva Ley obliga al subcontratista a emitir factura electr\u00f3nica en su relaci\u00f3n con un contratista principal, siempre que \u00e9sta supere los 5.000 euros y el destinatario final sea la Administraci\u00f3n P\u00fablica.<\/strong><\/p>\n<p>De este modo, cuando un contratista haya obtenido un contrato para prestar bienes o servicios a una Administraci\u00f3n, y \u00e9ste, a su vez acude a un aut\u00f3nomo o pyme, para cubrir parte de ese contrato, esta persona pasar\u00e1 a ser un subcontratista y estar\u00e1 sujeto a esta nueva obligaci\u00f3n.<\/p>\n<p>De acuerdo con la nueva Ley de Contrataci\u00f3n P\u00fablica, desde el pasado 1 de julio aquellos aut\u00f3nomos y pymes que act\u00faen como subcontratistas, y siempre que el destinatario final sea la Administraci\u00f3n P\u00fablica, tendr\u00e1n la obligaci\u00f3n de presentar en formato factura en los servicios prestados o bienes entregados al contratista principal.<\/p>\n<p>El subcontratista deber\u00e1 entregar el documento justificativo al contratista a trav\u00e9s de un Registro, y el contratista har\u00e1 lo mismo para su remisi\u00f3n al \u00f3rgano administrativo al que corresponda la tramitaci\u00f3n de la factura.<\/p>\n<p>Por ahora el FACe (Punto General de Entrada de Facturas Electr\u00f3nicas) es el punto general de entrada de facturas electr\u00f3nicas de la Administraci\u00f3n General del Estado.<\/p>\n<p>La factura electr\u00f3nica lleva implement\u00e1ndose desde el a\u00f1o 2015 con la entrada en vigor de la <a href=\"https:\/\/www.boe.es\/buscar\/pdf\/2013\/BOE-A-2013-13722-consolidado.pdf\">Ley 25\/2013<\/a>, cuando comenz\u00f3 a exigirse para poder trabajar como proveedor de la Administraci\u00f3n P\u00fablica y entre grandes empresas.<\/p>\n<p>En principio, una factura electr\u00f3nica tiene que cumplir con los mismos requisitos que una factura en formato papel. El documento debe contener los campos exigibles a toda factura y ser transmitido de un ordenador a otro recogiendo el consentimiento de ambas partes.<\/p>\n<p><strong>\u00bfC\u00f3mo puedo expedir facturas electr\u00f3nicas?<\/strong><\/p>\n<p>Mediante un programa inform\u00e1tico que sea capaz de crear facturas electr\u00f3nicas.
